By accessing the Website you accept and agree to be bound by these terms and conditions. The Website is owned and operated by Moving Image Communications Ltd..

1. Payment Methods

We accept all major credit cards including, Visa, MasterCard, Eurocard, Visa Debit, Switch, Delta. There is NO SURCHARGE for credit card purchases with Moving Image Communications Ltd.. Please be sure to provide your correct billing address and telephone number. Incorrect information may cause a delay in producing your order. Your credit card will be billed upon PLACING YOUR ORDER.

All prices are subject to VAT and any other applicable sales taxes.

2. Delivery

We aim to deliver your DVD as quickly as possible, and certainly within 7 days from the date of your order. Our normal delivery method is Royal Mail although this may change from time to time. The standard delivery charge is £3.45 per DVD. Goods will be sent by first class mail to the delivery address requested in your order. The risk of loss and title passes to you upon our delivery to the carrier, such as Royal Mail.

3. DVD Player Compatibility

3.1 The DVD discs that we produce are industry standard DVD-R discs.

3.2 DVD-R discs play on most DVD players (including on most DVD-ROM drives in PC's). However you should be aware that discs might not work in all players/drives. You can obtain compatibility information by contacting your equipment seller or manufacturer with your players' full make and model number.

3.3 Should you not provide the make and model of your DVD playback equipment, or if you specifically ask for a DVD-R disc to be produced, be aware that without limitation to paragraph 7 below, we would be unable to make a refund if your DVD player is not compatible with the DVD-R disc.

4. Faulty Goods

4.1 We do our best to ensure the DVD-R discs used are fit for purpose. You should be aware that DVD-Rs are not designed to last forever and should be used and treated carefully. However if you feel the DVD we supply is faulty please return the same or contact us at Moving Image Communications Ltd. and we will arrange collection. Provided:

4.1.1 you have not damaged the DVD;

4.1.2 the DVD is faulty; and

4.1.3 you were not told of the faults before using the DVD.

We will happily replace the DVD or offer you a full refund.

5 Privacy & Confidentiality Policy

5.1 We promise to respect the privacy & confidentiality of your identity and audio visual material. We will not supply your contact information to any third party companies other than is needed to perform our obligations herein or unless you specifically ask us to.

5.2 Unless you have expressly told us to the contrary, from time to time in accordance with our Privacy Policy we may email you with special offers and other related news. However you can remove yourself from our mailing list by simply replying to any sent messages from Moving Image Communications Ltd., and typing in "REMOVE" in the subject line.

6. Disclaimers

6.1 Moving Image Communications Ltd. does not guarantee the accuracy, compatibility or operation of the DVD and hereby excludes all liability whatsoever for any loss, damage or claims arising from your order, the DVD and your use of the Website, subject to the terms herein.

6.2 Without limitation to the above, so far as the same is permitted by law Moving Image Communications Ltd. will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings) any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including through negligence) arising out of or in connection with this Agreement. Without limitation we cannot be responsible for damaged or mishandled discs and it is the customers responsibility to protect the supplied DVD's from scratches or other damage. Small run DVD's are produced under a different process than the "Hollywood Movies" you buy or rent. These large volume discs are produced from Glass Masters and have double the capacity of the individually recorded discs. Individual DVD-R discs are "burnt" in a similar way to the more familiar CD discs, they will not be able to cope with rough handling.

6.3 The Website may from time to time have links to other third party websites that Moving Image Communications Ltd. do not control. Moving Image Communications Ltd. is not responsible for the content of such third party websites and does not examine, endorse, control or monitor such websites or the information therein.

6.4 Moving Image Communications Ltd. shall have no liability for any content on the Website or for any disruption or interruption of content downloaded from the Website onto any computer hardware or software.

6.5 The Website, the DVDs and any content on the Website are all provided on an "as is" basis and Moving Image Communications Ltd. make no representation or warranty of any kind (whether express or implied) relating to the Website, its content, the DVDs including without limitation any representation or warranty about the availability, operation, accuracy, completeness, quality, compatibility, merchantability or fitness for any purpose of the same.

6.6 In the event, notwithstanding the above, Moving Image Communications Ltd. is found liable herein so far as is permitted by law, Moving Image Communications Ltd.'s liability shall be capped at the value of the monies paid by you to Moving Image Communications Ltd..

7. Currency

All prices quoted are in UK Pounds Stirling unless stated otherwise. If you wish to pay in Euro or other currencies then the applicable currency conversion rate at the time of purchase will be applied.

8. Returns Policy

Our returns policy is in accordance with the Consumer Protection (Distance Selling) Regulations 2000. Because the DVD's are made to your individual specifications you are not able to cancel or return your order other than where there is a fault (see paragraph 4). It's therefore really important that you check your order before submitting it to Moving Image Communications Ltd..

Please note: As above, we do not accept responsibility for goods damaged in transit, if the packaging of your parcel is compromised then immediately contact the party delivering the goods (if possible photograph the damaged parcel before opening it).

9. Copyright and Related Rights

9.1 You agree and acknowledge that all intellectual property rights in and to the Website belong and are hereby reserved to Moving Image Communications Ltd..

9.2 All copyright in and to the DVDs is hereby reserved to Moving Image Communications Ltd. subject to the rights of any underlying rights owners.

9.3 You agree that you will access the Website solely for your own private use and not for any commercial or public use. You may download, display and use the content on the website only on a single computer screen at a time for your non-commercial, personal use and strictly for the purpose of viewing and selecting content for use on a compilation DVD. You agree that you may not copy, reproduce, republish, download, post, adapt, create a derivative work from, distribute, store in any medium (including in any other website), broadcast, transmit, retransmit, modify or show in public all or any part of the content on the Website without the prior written permission of Moving Image Communications Ltd.

9.4 Any use of the content or the Website not expressly permitted by these terms and conditions are prohibited unless authorised in writing by Moving Image Communications Ltd.. You agree to use this Website for lawful purposes only, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this Website by any third party. Such restriction or inhibition includes, without limitation, the introduction into the Website or the content of a virus, file or code that may damage, destroy, interrupt or otherwise interfere with the normal functionality of the Website or any associated computer software, databases or hardware.

10. Your Obligations

You agree and undertake:

10.1 that you will not use the Website or its content for purposes other than are expressly provided herein.

10.2 that you shall not remove any copyright, trademark or other intellectual property notice from the Website or content.

10.3 that you shall not do anything that could interfere, damage or interrupt any functionality of the Website, content or any computer software or hardware.

11. Indemnity

Your hereby agree to indemnify and hold Moving Image Communications Ltd. and its officers, content providers, agents and associates harmless from and against all and any expenses, losses, damages, liabilities or costs suffered as a result of your use of or content on the Website, the DVD and/or your breach of any of these terms and conditions.

12. General

12.1 Moving Image Communications Ltd. reserves the right to make changes to any part of the Website and these terms and conditions, without formal notice to you. It is your responsibility to check the terms and conditions each time you access the site, otherwise as above by accessing and using the Website you are deemed to have accepted the terms and conditions (and any changes therein).

12.2 If any provision of these terms and conditions are held by any competent court or regulatory authority to be void or unenforceable in whole or in part and such provision is not fundamental to the commercial purpose of these terms and conditions it shall be deemed to be severed from these terms and conditions and the terms and conditions shall continue in force in relation to the unaffected provisions. The parties shall negotiate in good faith (a) replacement term(s) for the severed provision in order to achieve as closely as possible the original intentions of the parties.

12.3 These terms and conditions shall be governed by and construed in accordance with English law.
